Terms of Service

BaligyAklan (“the Service”) is a peer-to-peer marketplace that connects buyers and sellers in Aklan province, Philippines. It is developed and operated by Lumtri Software Development Services(“we,” “us”), a DTI-registered business in the Philippines. BaligyAklan is a platform only — we do not buy, sell, or take possession of any item. All transactions are between users.

• You must be at least 18 years old.
• You must be a resident of, or physically present in, the Philippines (Aklan recommended).
• You must provide accurate signup information and keep it current.

• You are responsible for all activity on your account, including maintaining the confidentiality of your password.
• One account per person. Creating multiple accounts to evade suspensions or boost ratings is prohibited.
• We may require ID verification before allowing certain actions (e.g., reserving high-value listings).

• You may only list items you legally own and have the right to sell.
• Listing descriptions, photos, and prices must be accurate. Price is always required and must be greater than zero.
• We may remove listings that violate these Terms or applicable law, with or without notice.

You may not list, sell, buy, or attempt to transact:

• Illegal drugs, controlled substances, or drug paraphernalia.
• Firearms, ammunition, explosives, or weapons.
• Counterfeit goods or stolen property.
• Live animals (other than legal small pets with proper care context), endangered species, or animal parts.
• Human remains, body parts, or bodily fluids.
• Adult content, intimate services, or anything that sexualizes minors.
• Government IDs, passports, voter information, or other identity documents.
• Recalled, hazardous, or unsafe items (e.g., uncertified electronics).

You may not harass, threaten, defraud, or impersonate other users. You may not scrape, spam, or attempt to disrupt the Service.

• All transactions are peer-to-peer. BaligyAklan does not collect, hold, or process payments.
• Payment is exchanged in person at the agreed meetup, typically in cash. We strongly recommend meeting at one of the listed safe meetup spots.
• You are responsible for verifying the item, the seller's identity, and the cash exchanged at the meetup.
• BaligyAklan does not guarantee that a listing exists, is accurately described, or that any user will follow through on a deal.

The marketplace is free to use. BaligyAklan Pro is an optional paid upgrade for sellers (₱149 per month or ₱1,490 per year) that unlocks unlimited listings, boost credits, a Pro badge, listing insights, and priority support.

• One-time payment, no auto-renew. Each purchase covers a single period and is paid once through PayMongo (GCash, Maya, QR Ph, or card). We do not store your card and never charge you automatically — when your period ends, Pro simply lapses unless you choose to buy again.
• Immediate access. Pro features and boost credits are available as soon as your payment is confirmed.
• Refunds. Because Pro features and boost credits are usable immediately, purchases are generally non-refundable once the period begins. We will always make it right, though: if you were charged twice, charged without receiving access, or charged in error, email us and we'll refund or fix it. And if you bought Pro but haven't used any credits or features, contact us within 7 days for a full refund.
• Price changes apply only to future purchases, never to a period you've already paid for.

• Some actions require ID verification. We may ask you to submit a government-issued ID for review.
• Phone numbers are revealed to the other party only after both parties confirm a meetup. Sharing phone numbers in chat before this point is at your own risk.

After a completed deal, you may rate the other party. Ratings must be honest and based on the actual transaction. Fake or retaliatory ratings may be removed.

We may suspend or terminate your account, with or without notice, for violations of these Terms, fraud, safety concerns, or repeated disputes. You may delete your account at any time by contacting us.

The Service is provided “as is.” We make no warranties about availability, reliability, accuracy of listings, or the conduct of any user. We are not a party to any transaction and are not responsible for the quality, legality, or safety of items exchanged.

To the maximum extent permitted by Philippine law, BaligyAklan and its operators are not liable for indirect, incidental, or consequential damages arising from your use of the Service or any transaction with another user.

These Terms are governed by the laws of the Republic of the Philippines. Any dispute that cannot be resolved through good-faith communication will be heard in the courts of Aklan province.

We may update these Terms as the Service evolves. Material changes will be announced in the app or via email. Continued use after changes means you accept the updated Terms.
